ಮೈಸೂರು, ಸೆ.21, 2021 : (www.justkannada.in news ) ವಿವೇಕ ಸ್ಮಾರಕ ಸ್ಥಳ ವಿವಾದ ಪ್ರಕರಣ. ರಾಜ್ಯ ಸರ್ಕಾರ ಹಾಗೂ ರಾಮಕೃಷ್ಣ ಆಶ್ರಮದ ವಿರುದ್ಧ ಸಲ್ಲಿಸಿದ್ದ ಅರ್ಜಿ ವಜಾ. ವಿವಾದಿತ ಸ್ಥಳವನ್ನು ವಿವೇಕ ಸ್ಮಾರಕ ನಿರ್ಮಾಣಕ್ಕೆ ಬಿಟ್ಟುಕೊಡುವಂತೆ ಹೈಕೋರ್ಟ್ ಏಕ ಸದಸ್ಯ ಪೀಠದಿಂದ ಆದೇಶ.
ಎನ್‌ಟಿಎಂ ಶಾಲೆಯ 20ಕ್ಕೂ ಹೆಚ್ಚು ವಿದ್ಯಾರ್ಥಿಗಳಿಂದ ಸಲ್ಲಿಸಲಾಗಿದ್ದ ರಿಟ್ ಅರ್ಜಿ. ಅದೇ ಶಾಲೆಯಲ್ಲಿ ಓದಲು ಅವಕಾಶ ಮಾಡಿಕೊಡುವಂತೆ ಕೇಳಿಕೊಂಡು ಅರ್ಜಿ. ಸುಮಾರು 10-12 ಕಿಲೋಮೀಟರ್ ದೂರದಿಂದ ಶಾಲೆಗೆ ಬರುತ್ತಿದ್ದ ಮಕ್ಕಳು. ಇದನ್ನ ಕೋರ್ಟ್ ಗಮನಕ್ಕೆ ತಂದಿದ್ದ ಆಶ್ರಮದ ಪರವಾದ ವಕೀಲ. ತಮ್ಮ ಪ್ರದೇಶದ ಹತ್ತಿರದಲ್ಲಿರುವ ಶಾಲೆಯಲ್ಲಿ ಓದಿ. ಇದೇ ಶಾಲೆಯಲ್ಲಿ ಓದಬೇಕು ಎಂಬುದು ಮೂಲಭೂತ ಹಕ್ಕಲ್ಲ ಎಂದ ಕೋರ್ಟ್. ವಿವಾದಿತ ಸ್ಥಳ ವಿವೇಕ ಸ್ಮಾರಕ ನಿರ್ಮಾಣಕ್ಕೆ ಬಿಟ್ಟುಕೊಡುವಂತೆ ಆದೇಶ.

ENGLISH SUMMARY :
A writ petition in WP 1017/2021 was filed by few students of NTM School before the High Court of Karnataka against State and Ramakrishna Ashrama alleging that the shifting of NTM School, infringes upon their fundamental Right to Education and they had also challenged the transfer of land to Ramakrishna Ashrama vide G.O dated 09.01.2013. The said Writ Petition has been dismissed by the Hon’ble High Court of Karnataka today.
In view of the dismissal of the above Writ Petition, all the contentions that the students had raised in the above Writ Petition have been rejected by the Hon’ble High Court of Karnataka.
In view of the above, there is no impediment for the State to implement the G.O. dated 09.01.2013 and subsequent orders passed in continuation of the same.
