ಬೆಂಗಳೂರು, ಆಗಸ್ಟ್ 18,2021(www.justkannada.in): ಆರೋಗ್ಯ ಮತ್ತು ಕುಟುಂಬ ಕಲ್ಯಾಣ ಇಲಾಖೆಯ ಅಧಿಕಾರಿಗಳು ಮತ್ತು ನೌಕರರ ವರ್ಗಾವಣೆ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ ಕೌನ್ಸಿಲಿಂಗ್ ಕಡ್ಡಾಯಗೊಳಿಸುವುದರ ಮೂಲಕ ಕಟ್ಟುನಿಟ್ಟಿನ ಕ್ರಮಕ್ಕೆ ಆರೋಗ್ಯ ಮತ್ತು ವೈದ್ಯಕೀಯ ಶಿಕ್ಷಣ ಸಚಿವ ಡಾ.ಕೆ.ಸುಧಾಕರ್ ನಾಂದಿ ಹಾಡಿದ್ದಾರೆ.
ಈ ಮೂಲಕ ಇಲಾಖೆಯಲ್ಲಿ ಅನಿಯಮಿತ ವರ್ಗಾವಣೆಗೆ ತಡೆ ಹಾಕಿ, ಇಲಾಖೆಯ ಕಾರ್ಯನಿರ್ವಹಣೆಯಲ್ಲಿ ಶಿಸ್ತು, ಪಾರದರ್ಶಕತೆ ಹಾಗೂ ದಕ್ಷತೆ ತರಲಾಗಿದೆ. ಇದರಿಂದಾಗಿ ಇನ್ನು ಮುಂದೆ ಸಾರ್ವಜನಿಕರಿಗೆ ಯಾವುದೇ ಅಡ್ಡಿ ಇಲ್ಲದೆ ಸಮರ್ಪಕ ಆರೋಗ್ಯ ಸೇವೆ ಲಭ್ಯವಾಗಲಿದೆ.
ಆರೋಗ್ಯ ಇಲಾಖೆಯ ಆಡಳಿತದಲ್ಲಿ ದಕ್ಷತೆ ತಂದು ಭ್ರಷ್ಟಾಚಾರ ಮುಕ್ತಗೊಳಿಸುವ ನಿಟ್ಟಿನಲ್ಲಿ ಈ ನಿರ್ಣಯ ಕೈಗೊಂಡಿದ್ದು, ಪಾರದರ್ಶಕ ಹಾಗೂ ನಿಗದಿತ ಕಾಲಮಿತಿಯಲ್ಲಿ ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರಗಳ ಮೂಲಕವೇ ವರ್ಗಾವಣೆ ಮಾಡುವ ಕಾನೂನನ್ನು ಕಡ್ಡಾಯವಾಗಿ ಜಾರಿಗೊಳಿಸಲು ಉನ್ನತಾಧಿಕಾರಿಗಳ ಸಭೆಯಲ್ಲಿ ಸೂಚಿಸಲಾಗಿದೆ. ಈ ಸಂಬಂಧ ಈಗಾಗಲೇ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದ್ದು, ಶಿಫಾರಸು, ಲಾಬಿಗಳಿಗೆ ತಡೆ ಬಿದ್ದಿದೆ.
ಸಚಿವರಿಂದ ಸೂಚನೆ
ಇಲಾಖೆಯ ವ್ಯಾಪ್ತಿಯ ವೈದ್ಯಾಧಿಕಾರಿಗಳು ಮತ್ತು ಇತರೆ ಸಿಬ್ಬಂದಿಯ ವರ್ಗಾವಣೆಯನ್ನು ‘ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸಿವಿಲ್ ಸೇವೆಗಳ (ವೈದ್ಯಾಧಿಕಾರಿಗಳು ಮತ್ತು ಇತರೆ ಸಿಬ್ಬಂದಿಯ ವರ್ಗಾವಣೆ ನಿಯಂತ್ರಣ) ಕಾಯ್ದೆ 2011 ರ ಅನ್ವಯ ಕೌನ್ಸಿಲಿಂಗ್ ಮೂಲಕ ಮಾತ್ರ ಕೈಗೊಳ್ಳುವಂತೆ ಸ್ಪಷ್ಟ ಆದೇಶವಿದೆ. ಈ ಕಾಯ್ದೆಯ ಕಲಂ 5 ರಲ್ಲಿ ಆಡಳಿತಾತ್ಮಕ ಹುದ್ದೆಗಳಿಗೆ ಕೌನ್ಸಿಲಿಂಗ್ ನಿಂದ ವಿನಾಯಿತಿ ನೀಡಲಾಗಿದೆ. ಅಂತಹ ಪ್ರಸ್ತಾವಗಳನ್ನು ಸಚಿವರಿಗೆ ಕಳುಹಿಸಲಾಗುತ್ತದೆ.
ಆದರೆ ಇತರೆ ವರ್ಗಾವಣೆ ಪ್ರಸ್ತಾವಗಳನ್ನು ಕಳುಹಿಸಬಾರದು. ಒಂದು ವೇಳೆ ಹಾಗೆ ಮಾಡಿದರೆ ಕಡತ ನಿರ್ವಹಿಸುವ ವಿಷಯ ನಿರ್ವಹಕರು ಸೇರಿದಂತೆ ಸಂಬಂಧಿಸಿದ ಎಲ್ಲರ ವಿರುದ್ಧ ಇಲಾಖಾ ಶಿಸ್ತು ಕ್ರಮ ಜರುಗಿಸಬೇಕೆಂದು ಸಚಿವ ಡಾ.ಕೆ.ಸುಧಾಕರ್ ಸೂಚಿಸಿದ್ದಾರೆ.
ಗಂಭೀರ ಹಾಗೂ ಮಾರಣಾಂತಿಕ ರೋಗದಿಂದ ಬಳಲುತ್ತಿರುವವರು, ವಯೋ ನಿವೃತ್ತಿ ಅಂಚಿನಲ್ಲಿದ್ದು, ಇನ್ನು ಎರಡು ವರ್ಷ ಮಾತ್ರ ಸೇವೆ ಬಾಕಿ, ಶೇ.40 ಕ್ಕೂ ಹೆಚ್ಚು ಅಂಗವೈಕಲ್ಯ ಹೊಂದಿರುವವರು, ವಿಧವೆಯರು, ಪತಿ-ಪತ್ನಿ ಪ್ರಕರಣಕ್ಕೆ ಮಾತ್ರ ಕೌನ್ಸಿಲಿಂಗ್ ನಿಂದ ವಿನಾಯಿತಿ ನೀಡಬೇಕು. ಇಂತಹ ಪ್ರಸ್ತಾವಗಳನ್ನು ಅಪರ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿಯವರ ಸ್ಪಷ್ಟ ಶಿಫಾರಸಿನೊಂದಿಗೆ ಕಡತವನ್ನು ಎರಡು ತಿಂಗಳಿಗೊಮ್ಮೆ ಮಾತ್ರ ಸಚಿವರ ಅನುಮೋದನೆಗೆ ಸಲ್ಲಿಸಬೇಕು. ಈ ಕುರಿತು ಕಾಯ್ದೆಯಲ್ಲಿ ಅವಶ್ಯ ತಿದ್ದುಪಡಿ ತರಲು ಮುಂದಿನ ಕ್ರಮ ಕೈಗೊಳ್ಳುವಂತೆ ಸಚಿವ ಸುಧಾಕರ್ ಸೂಚನೆ ನೀಡಿದ್ದಾರೆ.
ವರ್ಗಾವಣೆ ಸಂಬಂಧ 2011 ರಲ್ಲಿ ಕಾನೂನು ರೂಪಿಸಿ, ನಿಯಮ ರಚಿಸಲಾಗಿದೆ. 2017 ರಲ್ಲಿ ಕಾನೂನಿಗೆ ತಿದ್ದುಪಡಿ ತಂದು ಜಾರಿಗೊಳಿಸಲಾಗಿದೆ. ಇನ್ನು ಮುಂದೆ ಈ ಕಾನೂನು ಅನ್ವಯ ವರ್ಗಾವಣೆ ನಡೆಯಲಿದೆ.
“ನಿಯಮ ಉಲ್ಲಂಘಿಸಿ ವರ್ಗಾವಣೆ ಪ್ರಸ್ತಾವನೆ, ಶಿಫಾರಸು ತಂದರೆ ಸಂಬಂಧಪಟ್ಟ ಸಿಬ್ಬಂದಿ ವಿರುದ್ಧ ಶಿಸ್ತು ಕ್ರಮ ಕೈಗೊಳ್ಳಲಾಗುವುದು. ಈ ನಿರ್ಧಾರದ ಮೂಲಕ ಅನಿಯಮಿತ ವರ್ಗಾವಣೆ, ಭ್ರಷ್ಟಾಚಾರಕ್ಕೆ ತಡೆ ಬೀಳಲಿದ್ದು, ಇಲಾಖೆಯ ಕಾರ್ಯನಿರ್ವಹಣೆಯಲ್ಲಿ ಶಿಸ್ತು ಹಾಗೂ ಆರೋಗ್ಯ ಸೇವೆ ಒದಗಿಸುವಲ್ಲಿ ದಕ್ಷತೆ ಬರಲಿದೆ” ಎಂದು ಸಚಿವ ಡಾ.ಕೆ.ಸುಧಾಕರ್ ತಿಳಿಸಿದ್ದಾರೆ.
ನಿಯಮದಲ್ಲೇನಿದೆ?
ಹಿರಿಯ ತಜ್ಞರು, ತಜ್ಞರು, ಉಪಮುಖ್ಯ ವೈದ್ಯಾಧಿಕಾರಿ, ಹಿರಿಯ ವೈದ್ಯಾಧಿಕಾರಿ, ಸಾಮಾನ್ಯ ಕರ್ತವ್ಯ ವೈದ್ಯಾಧಿಕಾರಿ, ಮುಖ್ಯ ದಂತ ವೈದ್ಯಾಧಿಕಾರಿ, ಹಿರಿಯ ದಂತ ವೈದ್ಯಾಧಿಕಾರಿ, ದಂತ ವೈದ್ಯಾಧಿಕಾರಿಗಳ ವರ್ಗಾವಣೆಯನ್ನು ಇಲಾಖೆಯ ಆಯುಕ್ತರು ಮಾಡಬಹುದು. ಗ್ರೂಪ್ ಬಿ, ಸಿ, ಡಿ ನೌಕರರನ್ನು ಇಲಾಖೆಯ ನಿರ್ದೇಶಕರು ವರ್ಗಾವಣೆ ಮಾಡಬಹುದು. ಆಯುಷ್ ಇಲಾಖೆಯಡಿಯ ಫಿಸಿಶಿಯನ್ ಗ್ರೇಡ್ 1, ಗೇಡ್ 2 ಗೆ ಆಯುಷ್ ಇಲಾಖೆಯ ನಿರ್ದೇಶಕರು, ಆಯುಷ್ ಇಲಾಖೆಯ ಗ್ರೂಪ್ ಬಿ, ಸಿ, ಡಿ, ನೌಕರರಿಗೆ ಇಲಾಖೆಯ ನಿರ್ದೇಶಕರು ವರ್ಗಾವಣೆ ಮಾಡಬಹುದು.
ಗ್ರೂಪ್-ಎ ಗೆ ಮೂರು ವರ್ಷ, ಗ್ರೂಪ್-ಬಿ ಗೆ ನಾಲ್ಕು ವರ್ಷ, ಗ್ರೂಪ್-ಸಿ ಗೆ ಐದು ವರ್ಷ, ಗ್ರೂಪ್-ಡಿ ಗೆ ಏಳು ವರ್ಷ ಒಂದು ಕಡೆ ಕಡ್ಡಾಯವಾಗಿ ಸೇವೆ ಸಲ್ಲಿಸಲು ನಿಯಮದಲ್ಲಿ ತಿಳಿಸಲಾಗಿದೆ.

Transfers only through Counselling as mandated by law

Health Minister Dr.K.Sudhakar in an order issued on Wednesday has directed to make counselling mandatory for transfers of medical officers and other staff in the state health and family welfare department putting a break to arbitrary transfers that were happening round the year through recommendations and other corrupt practices.
This decision will enhance transparency and efficiency in the functioning of the department and improve delivery of healthcare services to citizens preventing arbitrary transfers based on recommendations and lobbying.
How it will be implemented
‘The Karnataka State Civil Services (Regulation of Transfer of Medical Officers and other Staff) Act’, 2011 provides that all transfers of medical officers and other staff in the health and family welfare department must happen though counselling. The act exempts administrative positions from counseling and transfer of such cases has to be brought to the notice of the minister.
No other transfer proposals should be taken up. In case if anyone violates the order, all concerned staff will be subjected to strict departmental disciplinary action, Minister Dr.K.Sudhakar warned in his order.
Employees who are battling serious illness, who are on the verge of retirement, those who have less than 2 years of service, those who are 40% or more physical handicap, widows, husband and wife mutual transfer and other such special cases based on humanitarian grounds will be considered for transfer only once in 2 months and the act will also be recommended accordingly, said minister.
The Act regarding transfer has been passed in 2011 and rules also have been framed. The act has also been amended once in 2017. Going forward all transfers will be conducted as per the provisions of the law.
This decision will not only ensure transparency and discipline in transfers of medical officers and other staff but also prevents corruption and arbitrary transfers which negatively impact the functioning of the department and delivery of healthcare services to the people, Dr.Sudhakar said in his tweet.
What does the rules say
Senior specialists, specialists, deputy chief medical officer, senior medical officer, general duty medical officer, chief dental health officer, senior dental helath officer, dental health officer can be transferred by commisioner of the department. Group B, C and D staff can be transferred by Department Director and the same applies to AYUSH Department.
The rules mandate 3 years, 4 years, 5 years and 7 years mandatory service in one posting for Group A, B, C, and D employees respectively.
