ಬೆಂಗಳೂರು, ಆ.04, 2019 : (www.justkannada.in news) ಮಾಜಿ ಸಚಿವ ಮತ್ತು ಕಾಂಗ್ರೆಸ್ ಮುಖಂಡ ಡಿ.ಕೆ. ಶಿವಕುಮಾರ್ ಅವರು ತಮ್ಮ ವಿರುದ್ಧ ಸುಳ್ಳು ಆರೋಪ ಮಾಡಿರುವ ಕೇಂದ್ರದ ಮಾಜಿ ಸಚಿವ, ಬಿಜೆಪಿ ಮುಖಂಡ ಹಾಗೂ ವಿಜಯಪುರ ನಗರ ಶಾಸಕ ಬಸನಗೌಡ ಪಾಟೀಲ್ ಯತ್ನಾಳ್ ವಿರುದ್ಧ 204 ಕೋಟಿ ರುಪಾಯಿಗೆ ಮಾನನಷ್ಟ ಮೊಕದ್ದಮೆ ಹೂಡಿದ್ದಾರೆ.
ತಮ್ಮ ತವರು ಕ್ಷೇತ್ರ ಬೆಂಗಳೂರು ಗ್ರಾಮಾಂತರ ಜಿಲ್ಲೆಯ ಕನಕಪುರದ ಸೀನಿಯರ್ ಸಿವಿಲ್ ಜಡ್ಜ್ ಹಾಗೂ ಜೆಎಂಎಫ್ಸಿ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಡಿ.ಕೆ. ಶಿವಕುಮಾರ್ ದಾಖಲಿಸಿರುವ ಮಾನನಷ್ಟ ಸಿವಿಲ್ ಮೊಕದ್ದಮೆ (288/2019) ಅರ್ಜಿಯನ್ನು ವಿಚಾರಣೆಗೆ ಅಂಗೀಕರಿಸಿರುವ ನ್ಯಾಯಾಧೀಶರು ಪ್ರತಿವಾದಿ ಬಸನಗೌಡ ಪಾಟೀಲ್ ಯತ್ನಾಳ್ ಅವರಿಗೆ ಸಮನ್ಸ್ ಜಾರಿ ಮಾಡಿದ್ದಾರೆ. ಪ್ರಕರಣದ ಮುಂದಿನ ವಿಚಾರಣೆಯನ್ನು ಬರುವ ಸೆಪ್ಟೆಂಬರ್ 18 ಕ್ಕೆ ನಿಗದಿ ಮಾಡಲಾಗಿದೆ.
ಅರ್ಜಿದಾರ ಡಿ.ಕೆ. ಶಿವಕುಮಾರ್ ಅವರು ನ್ಯಾಯಾಲಯಕ್ಕೆ ಚೆಕ್ ಮೂಲಕ 1 ಕೋಟಿ 4 ಲಕ್ಷದ 8 ಸಾವಿರ ರುಪಾಯಿ ಕೋರ್ಟ್ ಶುಲ್ಕ ಪಾವತಿಸಿದ್ದಾರೆ.
ಆರೋಪಿ ಬಸನಗೌಡ ಪಾಟೀಲ್ ಯತ್ನಾಳ್ ಅವರು ಕಳೆದ ಜೂನ್ 23 ರಂದು ವಿಜಯಪುರದಲ್ಲಿ ಮಾಧ್ಯಮದವರ ಜತೆ ಮಾತನಾಡುತ್ತಾ ತಮ್ಮ ಬಗ್ಗೆ ಮಾನಹಾನಿಕಾರಿ ಹೇಳಿಕೆ ನೀಡಿದ್ದಾರೆ. ಡಿ.ಕೆ. ಶಿವಕುಮಾರ್ ಅವರು ತಮ್ಮ ವಿರುದ್ಧ ದಾಖಲಾಗಿರುವ ಆದಾಯ ತೆರಿಗೆ ಇಲಾಖೆ (ಐಟಿ), ಜಾರಿ ನಿರ್ದೇಶನಾಲಯದ (ಇಡಿ) ಪ್ರಕರಣಗಳಿಂದ ಮುಕ್ತಿಗೊಳಿಸಲು ಸಹಾಯ ಮಾಡುವಂತೆ ಬಿಜೆಪಿ ರಾಷ್ಟ್ರೀಯ ಅಧ್ಯಕ್ಷರು ಹಾಗೂ ಕೇಂದ್ರದ ಸಚಿವರುಗಳ ಮೇಲೆ ಒತ್ತಡ ಹಾಕುತ್ತಿದ್ದಾರೆ. ನನ್ನ ವಿರುದ್ಧದ ಪ್ರಕರಣಗಳನ್ನು ಮುಕ್ತಾಯ ಮಾಡಿದರೆ ಇದಕ್ಕೆ ಪ್ರತಿಯಾಗಿ ಕರ್ನಾಟಕದಲ್ಲಿ ಬಿಜೆಪಿ ಸರಕಾರ ಮಾಡಲು ನಾನು ವಿರೋಧ ಮಾಡುವುದಿಲ್ಲ ಅಂತ ಭರವಸೆ ನೀಡಿದ್ದಾರೆ ಎಂದು ಯತ್ನಾಳ್ ಅವರು ಈ ಸಂದರ್ಭದಲ್ಲಿ ಸುಳ್ಳು ಆರೋಪ ಮಾಡಿದ್ದಾರೆ. ಯತ್ನಾಳ್ ಅವರ ಈ ಹೇಳಿಕೆ ಎಲೆಕ್ಟ್ರಾನಿಕ್ ಹಾಗೂ ಮುದ್ರಣ ಮಾಧ್ಯಮದಲ್ಲಿ ಪ್ರಸಾರವಾಗಿದೆ. ಯತ್ನಾಳ್ ಅವರ ಸತ್ಯಕ್ಕೆ ದೂರವಾದ ಹೇಳಿಕೆಯಿಂದ ತಮ್ಮ ಪ್ರಾಮಾಣಿಕತೆ, ನೈತಿಕತೆ, ಪ್ರತಿಷ್ಠೆ ಹಾಗೂ ವರ್ಚಸ್ಸಿಗೆ ಧಕ್ಕೆಯಾಗಿದೆ. ಯತ್ನಾಳ್ ಅವರ ಈ ಆರೋಪ ಆಧಾರರಹಿತ, ದುರುದ್ದೇಶಪೂರ್ವಕ ಹಾಗೂ ಬೇಜವಾಬ್ದಾರಿಯಿಂದ ಕೂಡಿದ್ದು, ತಮ್ಮ ಮಾನಕ್ಕೆ ಹಾನಿ ಮಾಡಿದೆ ಎಂದು ಶಿವಕುಮಾರ್ ಆರ್ಜಿಯಲ್ಲಿ ವಾದಿಸಿದ್ದಾರೆ.
ತಮ್ಮ, ತಮ್ಮ ಕುಟುಂಬ ಸದಸ್ಯರು, ಬಂಧುಗಳು ಹಾಗೂ ಸ್ನೇಹಿತರ ವಿರುದ್ಧ ಐಟಿ ಮತ್ತು ಇಡಿ ದಾಖಲು ಮಾಡಿರುವ ಪ್ರಕರಣಗಳ ಸಂಬಂಧ ನಾನಾ ನ್ಯಾಯಾಲಯಗಳಲ್ಲಿ ವಿಚಾರಣೆ ನಡೆಯುತ್ತಿದೆ. ಆದರೆ ಯತ್ನಾಳ್ ಅವರು ಮಾಡಿರುವ ಈ ಸುಳ್ಳು ಆರೋಪವು ಕಾನೂನು ಸಂಸ್ಥೆಗಳ ದಿಕ್ಕುತಪ್ಪಿಸುವ ಹಾಗೂ ಅವುಗಳ ಮೇಲೆ ಪ್ರಭಾವ ಬೀರುವ ಹುನ್ನಾರದಿಂದ ಕೂಡಿದೆ. ಅಷ್ಟೇ ಅಲ್ಲದೆ ತಾವು ಪ್ರತಿನಿಧಿಸುತ್ತಿರುವ ಕನಕಪುರ ವಿಧಾನಸಭೆ ಕ್ಷೇತ್ರದ ಮತದಾರರು, ಕಾಂಗ್ರೆಸ್ ಪಕ್ಷದ ಮುಖಂಡರು, ಕಾರ್ಯಕರ್ತರು, ಕರ್ನಾಟಕ ಹಾಗೂ ಭಾರತದ ಪ್ರಜೆಗಳು ತಮ್ಮನ್ನು ಅನುಮಾನದಿಂದ ನೋಡುವಂತೆ ಮಾಡಿದೆ. ನನ್ನ ವೈಯಕ್ತಿಕ ಹಿತಾಸಕ್ತಿಗಾಗಿ ಪಕ್ಷ ಹಾಗೂ ಸಾರ್ವಜನಿಕರ ಹಿತ ಬಲಿಕೊಡಲು ಮುಂದಾಗಿದ್ದೇನೆ ಎಂಬ ಭಾವನೆ ಮೂಡುವಂತೆ ಮಾಡಿದೆ. ಹಿಂದಿನ ಕಾಂಗ್ರೆಸ್ ಹಾಗೂ ಜೆಡಿಎಸ್ ಮೈತ್ರಿ ಸರಕಾರ ರಚನೆಯಲ್ಲಿ ಪ್ರಮುಖ ಪಾತ್ರ ವಹಿಸಿದ ತಮ್ಮನ್ನು ಅದೇ ಸರಕಾರ ಅಸ್ಥಿರಗೊಳಿಸಲು ಮುಂದಾಗಿದ್ದೇನೆ ಎಂಬರ್ಥ ಬರುವ ಹೇಳಿಕೆ ನೀಡುವ ಮೂಲಕ ಯತ್ನಾಳ್ ತಮ್ಮ ಪ್ರಾಮಾಣಿಕತೆ, ಬದ್ಧತೆ, ಘನತೆ ಹಾಗೂ ಗೌರವಕ್ಕೆ ಚ್ಯುತಿ ತಂದಿದ್ದಾರೆ ಎಂದು ಶಿವಕುಮಾರ್ ಅರ್ಜಿಯಲ್ಲಿ ಆಪಾದಿಸಿದ್ದಾರೆ.
ಕರ್ನಾಟಕದಲ್ಲಿ ಬಿಜೆಪಿ ಸರಕಾರ ರಚನೆಗೆ ನೆರವಾಗುತ್ತೇನೆ ಎಂದು ತಾವು ಆ ಪಕ್ಷದ ವರಿಷ್ಠರಿಗೆ ಹೇಳಿರುವುದಾಗಿ ಯತ್ನಾಳ್ ಅವರು ಮಾಡಿರುವ ಆರೋಪವು ಗಂಭೀರ ಸ್ವರೂಪದ್ದಾಗಿದ್ದು, ಇದು ಕಾಂಗ್ರೆಸ್ ರಾಜ್ಯ, ರಾಷ್ಟ್ರೀಯ ಮುಖಂಡರು ಹಾಗೂ ಮೈತ್ರಿ ಸರಕಾರದ ಮುಖಂಡರು ಕೂಡ ತಮ್ಮನ್ನು ಗುಮಾನಿಯಿಂದ ನೋಡಲಿ ಮತ್ತು ತಮ್ಮ ರಾಜಕೀಯ ಭವಿಷ್ಯದ ಮೇಲೆ ಪ್ರತಿಕೂಲ ಪರಿಣಾಮ ಬೀರಲಿ ಎಂಬ ದುರುದ್ದೇಶದಿಂದಲೂ ಕೂಡಿದೆ ಎಂದು ಅರ್ಜಿದಾರರು ದೂರಿದ್ದಾರೆ.
ಹಿಂದಿನ ಮೈತ್ರಿ ಸರಕಾರದಲ್ಲಿ ಜಲ ಸಂಪನ್ನೂಲ ಸಚಿವರಾಗಿದ್ದ ತಾವು ಕೆಲವು ಬಾರಿ ದಿಲ್ಲಿಗೆ ಅಧಿಕೃತ ಭೇಟಿ ನೀಡಿರುವುದು ನಿಜ. ಜೂನ್ 12 ರಿಂದ ಜೂನ್ 19 ರ ನಡುವೆ ಇಂಥ ಪ್ರವಾಸ ಮಾಡಿದಾಗ ಕೇಂದ್ರದ ಕೆಲವು ಸಚಿವರುಗಳನ್ನು ಭೇಟಿ ಮಾಡಿ ಮಹದಾಯಿ, ಮೇಕೆದಾಟು ಸೇರಿದಂತೆ ಕರ್ನಾಟಕದ ನಾನಾ ಜಲ ಸಂರಕ್ಷಣೆ, ಕುಡಿಯುವ ನೀರಿನ ಯೋಜನೆಗಳ ಅನುಷ್ಠಾನಕ್ಕೆ ನೆರವಾಗುವಂತೆ ಮನವಿ ಮಾಡಿದ್ದೇನೆ. ಜಲ ಸಂಪನ್ನೂಲ ಸಚಿವರಾಗಿ ಅದು ತಮ್ಮ ಕರ್ತವ್ಯವೂ ಹೌದು. ಆದರೆ ಈ ಭೇಟಿ ಬೆನ್ನಲ್ಲೇ ಅಂದರೆ ಜೂನ್ 23 ರಂದು ಯತ್ನಾಳ್ ಅವರು ಈ ರೀತಿ ಅಪಾರ್ಥದ ಹೇಳಿಕೆಗಳನ್ನು ನೀಡಿರುವುದು ತಮ್ಮ ಕರ್ತವ್ಯನಿಷ್ಠೆ, ಗೌರವ ಹಾಗೂ ಘನತೆಗೆ ಭಂಗ ತಂದಿದೆ. ಯತ್ನಾಳ್ ಆರೋಪ ಕುರಿತು ಕನಕಪುರ ಕ್ಷೇತ್ರದ ಮತದಾರರು, ಕಾಂಗ್ರೆಸ್ ಮುಖಂಡರು ಹಾಗೂ ಕಾರ್ಯಕರ್ತರು ತಮ್ಮನ್ನು ಪ್ರಶ್ನೆ ಮಾಡಿದ್ದಾರೆ. ಇದರಿಂದ ತಮಗೆ ಮಾನಸಿಕ ಹಿಂಸೆಯಾಗಿದೆ. ಸಾರ್ವಜನಿಕರ ಎದುರು ಅನಗತ್ಯವಾಗಿ ತಲೆ ತಗ್ಗಿಸುವಂತೆ ಮಾಡಿದೆ ಎಂದು ಶಿವಕುಮಾರ್ ಅಲವತ್ತುಕೊಂಡಿದ್ದಾರೆ.
ಸಾರ್ವಜನಿಕ ಬದುಕಿನಲ್ಲಿ ತಮ್ಮ ಗೌರವ, ಘನತೆಗೆ ಕುಂದುಂಟು ಮಾಡಿರುವುದಕ್ಕೆ ಪ್ರತಿಯಾಗಿ ಬಸನಗೌಡ ಪಾಟೀಲ್ ಯತ್ನಾಳ್ ಅವರಿಂದ ತಮಗೆ 204 ಕೋಟಿ ರುಪಾಯಿ ಪರಿಹಾರ ಕೊಡಿಸಬೇಕು ಹಾಗೂ ಶಾಶ್ವತವಾಗಿ ತಮ್ಮ ವಿರುದ್ಧ ಮಾತಿನ ಹಾಗೂ ಬರಹ ಸ್ವರೂಪದಲ್ಲಿ ಯಾವುದೇ ಹೇಳಿಕೆ ನೀಡದಂತೆ ಅವರಿಗೆ ನಿರ್ಬಂಧ ಹೇರಬೇಕು ಎಂದು ಶಿವಕುಮಾರ್ ಅವರು ನ್ಯಾಯಾಲಯಕ್ಕೆ ಮನವಿ ಮಾಡಿದ್ದಾರೆ.
DK Shivakumar files Rs. 204 crore defamation case against BJP MLA Yatnal
Bangalore: Irked by false and baseless allegations by union former minister, BJP leader and Vijayapura MLA Basanagouda Patil Yatnal, former minister and Congress leader DK Shivakumar has filed a defamation suit for Rs. 204 crore.
Following the defamation suit (288/2019) filed by Mr. Shivakumar at his home town Kanakapura Senior Civil Judge and JMFC court, the judge has admitted the case and has issued summons to Mr. Basanagouda Patil Yatnal. The defamation case will be taken up for next hearing on September 18, 2019.
Already, Mr Shivakumar has paid court fee of Rs. one crore Four lakh Eight thousand (Rs. 1,04,08,000) to the court.
Mr. Yatnal while speaking to media persons at Vijayapura has issued a damaging, image tarnishing and baseless statements against Shivakumar on June 23, he has been exerting pressure on national level BJP leaders and union BJP ministers to ensure that he is free from cases that are being probed by the Income Tax (IT) department and Enforcement Directorate (ED). Mr. Shivakumar has promised to remain neutral and not becoming a stumbling block in the formation of BJP government in Karnataka. These statements have been beamed in electronic and print media too. These are the baseless, false, irresponsible and irrelevant statements made by Mr. Yatnal. These remarks are passed with malafide intension to malign and to tarnish my public image. This has put a huge question mark on my loyalty, sincerity, integrity and image at party and public level, stated Mr. Shivakumar in the defamation petition.
The probe by IT and ED, against me, my kith and kin and friends at various courts. But the false and baseless statements mislead the investigating agencies and mislead the probe. Further it is damaging to an extend that I am looked at with suspicion by Kanakapura assembly constituency voters, Congress leaders, workers, and citizens of India in general and Karnataka in particular. It gives an impression that I am sacrificing the trust of people, leaders and voters for my personal and political gains. I have played a pivotal role in bringing Congress – JD(S) government to power. With these baseless statement I am branded as a person instrumental in destabilising and dethroning the co-alition government. This has caused a major damage to my reputation, image and my loyalty towards the party.
The petition says that these irresponsible statements that I support to destabilise the co-alition government are aimed at with devious intension to impede my political prosperity and growth and to put my image at stake in the eyes of leaders of Congress at state level and Central level apart from co-alition leaders.
It is a fact that during my stint as Water resources minister I have undertaken several official visits to national capital Delhi. These visits and meetings between June 12 and 19 were scheduled with a host of Union ministers to discuss conservation of water and drinking water projects. Water sharing issues and project implementation relating to Mahadayi, Mekedatu were discussed at length. It was my primary concern and duty too as a water resources minister to resolve the issues in the larger interest of public. My official visits with large public interest have been misinterpreted by Mr.Yatnal to put me in bad light in the eyes of leaders, public,voters and central leadership. This has caused mental agony and distressed me.
In the light of damage and and distress caused Mr Shivakumar approached the court claiming a damage of Rs. 204 crore from Mr. Yatnal for his irresponsible statements. Further, he sought permanent restrain from Mr. Yatnal about the slanderous and maligning statement.
